My layman's understanding is that directors of a P/L can be held personally liable for trading while knowingly insolvent. Prosecution is a different matter from their liability or responsibility, but.

There are the more traditional options such as securing a lien on their car(s) and/or forcing them into administration. But that almost certainly costs lots more than you have lost.

Thanks for that info. I'm not sure how the deposit was paid, probably a bank transfer. It is a P/L company, not sure if that changes anything though.

If you paid the deposit by credit card, contact your card issuer for a chargeback for no-delivery of service. Your rights to do that are time limited to (usually) 60 days. If they ceased trading I am not sure how that might work out. If they have an active account with funds, your card issuer should be able to recoup the money.

Otherwise, you could send them a registered return receipted letter demanding your money back, but most companies that cease trading are insolvent, so your chances are not much.

Unless Aces High Classic car hire was a P/L company and knowingly trading insolvent, it is a civil matter between you and them.

Issue type: Complaint

Aces High Classic car hire in Ormeau in Queensland. Ordered a car for hire for my daughter, her boy friend and two friends for formal. Boyfriends mother got a confirmation email saying the car was booked, before we went to pay the final payment for the car tried ringing them first, lucky we didn't just pay them the whole lot, they will not answer their phone or email. Their website is still up but says on it they are not currently taking bookings. $220.00 down the drain and we now have to pay another $230 for another car we had to hire. Where can we go to address this situation?
